1) Definitions
The terms "GINGER", "Ginger Jewellery & Gifts" & "We" refer to sites, domains and aspects of the business owned and controlled by Ginger Jewellery & Gifts of King Street, Belper. The terms "You", "client" and "user" refers to you as an individual, sole trader, representative or employee using any of the services and sites controlled by Ginger Jewellery & Gifts, hereinafter referred to as "Ginger web sites".
2) Permissions
You the user grant us permission to use the data obtained by enquiry or orders placed for marketing purposes as we see fit.
3) Returns
We abide by the distance selling legislation (see here) - your statutory rights are protected when purchasing or returning goods supplied by us. If you receive any item which arrives defective, damaged or not fit for the intended purpose then we will accept returns. Upon receipt of the returned items we will determine the extent of a refund applicable and provided the goods do not fall under our no-return policy for health and safety reasons (this applies predominantly to earrings). All returned items should be sent to the shop address unless directed otherwise.
4) Changes to Details
It is your responsibility to ensure that Ginger have your correct details at the time of order. If for any reason these details change prior to dispatch of your order, you should inform Ginger of those changes by email or phone.
5) Security
You will upon subscription to our services be given a unique reference number that will appear on any and all future correspondance from Ginger Jewellery & Gifts. You are responsible for ensuring that this reference number remains within the private domain of your business. Ginger Jewellery & Gifts., will always contact your company if it believes that someone perporting to be a representative of your company is giving false, misleading or contrary information as a means of verification.
6) Responsibility
You fully understand that all information, data, text, software, music, sound, graphics, video, messages, photographs, or any other materials that are found within the site are the sole copyright of Ginger unless otherwise stated. Ginger Jewellery & Gifts., will, if a website owner changes the content of the site or the material of the site to NON family safe material, remove the web site link without notice.

7) Law
You agree that we may preserve content and may also disclose content if required to do so by law if necessary to (a) Comply with the legal process, (b) Enforce our policies and terms, (c) Any copyright disputes, (d) protect the right for us, you our users, and the public in whole.
8) Claims or Demands
You agree not to hold us, or any of our contacts, users, sponsors, affiliates or anyone at all connected with one of our domains harmless from any claims or demands. This includes all fees made by any other parties due to or arising from any content you post and submit.
9) Networks
You agree that the data processing for an order or enquiry needs to be used over various networks as we use more than one server.
10) Acts of God
We reserve the right to modify, discontinue (temporarily or permanently) any of our services or part thereof with or without notice should we be forced to do so for the company's future or benefit to you our users. You agree that we are not liable to you or any third party for any of the above. However we will do all that we can to keep our services open subject to "Acts of God" i.e.- Earthquakes, thunderstorms, floods, solar flares and electromagnetic pulses that could kill our server. This also includes civil disruption, war and rioting.
11) Advertisers / Sites links
All dealings that you have with any of the advertisers / sites within our site are totally your responsibility, You agree that we will not be held liable should any disputes arise with one of our advertisers or links. All links to external sites and/or services are provided on an "information purposes only" basis and we do not endorse these services in any way.
12) Warranty
You agree that your use of our products are on an "as is" and "as available" basis, we expressly disclaim all warranties of any kind. By submitting your details via post, fax or our online form you agree to these terms and conditions. We reserve the right to modify these Terms and Conditions at any time, However we will post any changes within a prominent location on our sites should they affect you or our service dramatically. These Terms and Conditions are correct as of 1st November 2007.
